Why is it necessary to legalize Ukrainian documents through consular legalization?

Consular legalization for Ukraine is a mandatory requirement to ensure the legality and validity of Vietnamese documents used in Ukraine, or vice versa.

Although Ukraine is a member of the Hague Convention, Vietnam is not yet a participant in this convention. Therefore, Vietnamese documents that need to be recognized in Ukraine must go through the consular legalization and consular certification.

Which documents require consular legalization for Ukraine?

When carrying out Ukraine consular legalization procedures, it is necessary to clearly identify the documents that must be legalized as well as the documents exempt from legalization.

Based on the Agreement on Mutual Legal Assistance in Civil Matters between Vietnam and Ukraine (1999), the Cooperation Agreement on Adoption, and the Exchange of Notes in 2011 between the Consular Department of the Ministry of Foreign Affairs and the Embassy of Ukraine in Vietnam, certain types of documents are exempt from consular legalization. However, these documents may still require consular certification if requested by the receiving party. Specifically:

  • Civil judgments and decisions on recognition or enforcement of civil judgments.
  • Civil status documents used for marriage, adoption, or establishing parent-child relationships.
  • Documents for adoption purposes.
  • Documents under the authority of consular officers.

Procedures for consular legalization of Vietnamese documents for use in Ukraine (U-krai-na)

Step 1: Request Documents from the Competent Authority

First, you need to obtain the documents you intend to use from the competent authority that issued them in Vietnam. Some examples include:

  • Birth certificate: Request from the People’s Committee where the birth was registered.
  • Divorce extract: Request from the court that issued the divorce decision.
  • Marriage certificate: Request from the People’s Committee or the authority where the marriage was registered.

Step 2: Legalize Documents in Vietnam

Next, you need to take the documents to the competent Vietnamese authority for legalization.

Authorities involved:

  • Consular Department (Ministry of Foreign Affairs) in Hanoi.
  • Department of Foreign Affairs, Ho Chi Minh City.

Verification details: The authority will check and certify the form, signature, and seal of the issuing officer, then affix a legalization stamp on the document.

Step 3: Legalization at the Embassy of Ukraine

After completing the legalization in Vietnam, you then take the documents to the Embassy of Ukraine in Hanoi.

    Based on experience, it is recommended to prioritize legalization of the original document and certified copy. Translations can be prepared additionally for use in specific cases.

Step 4: Retrieve Documents and Use in Ukraine

After completing the procedures, you will receive the documents legalized by the Embassy of Ukraine. These documents can now be officially used in Ukraine for transactions or any required purposes.

Step 2: Document Certification at the District Governor (Statsforvalteren)

The local District Governor has the authority to issue an Apostille for documents intended for use in countries that are members of the Hague Apostille Convention. For documents to be used in countries not participating in the Hague Convention (such as Vietnam), the next step of legalization must be carried out at the Ministry of Foreign Affairs.

Consular legalization procedures for Ukrainian documents (U-krai-na) for use in Vietnam

Legalization of Ukrainian documents for use in Vietnam must follow specific steps and clear regulations as follows:

Step 1: Prepare the application

In Ukraine, documents requiring consular legalization or an apostille are submitted via the postal service "Nova Poshta". The applicant bears the shipping costs, including both sending and receiving.

  • Copy of identification documents: passport, national ID card, or equivalent.
  • Application forms: Apostille form and consular legalization form.
  • Consular fee receipt: original.

  • Individual: ₴150 per document (or ₴300 for urgent service).
  • Organization: ₴450 per document (or ₴900 for urgent service).

Step 2: Submit Documents to the Processing Authority

Step 3: Additional Legalization (If Needed)

For official copies or translations of documents, they must first be certified at the Ministry of Justice of Ukraine before consular legalization.

Foreign official documents must be authenticated at the relevant diplomatic or consular authority before legalization.

Step 4: Completion at the Embassy of Vietnam in Ukraine

After completing legalization in Ukraine, bring the documents to the Embassy of Vietnam in Ukraine to carry out the final legalization step.
